A New York court recently struck down state Office of Mental Health regulations governing research involving subjects with impaired decisionmaking capacity. The court held that neither incapacitated adults nor minors could participate in any research protocol that contained a nontherapeutic element, irrespective of possible benefits to the subject or the importance of the knowledge to be gained. Although the decision rested on a technical point of law and dealt only with psychiatric research, the court's holding has significantly broader implications.

Regular musical activity as a complex multimodal lifestyle activity is proposed to be protective against age-related cognitive decline and Alzheimer’s disease. This cross-sectional study investigated the association and interplay between musical instrument playing during life, multi-domain cognitive abilities and brain morphology in older adults from the DZNE-Longitudinal Cognitive Impairment and Dementia Study study. Participants reporting having played a musical instrument across three life periods were compared to controls without a history of musical instrument playing, well-matched for reserve proxies of education, (...) intelligence, socioeconomic status and physical activity. Participants with musical activity outperformed controls in global cognition, working memory, executive functions, language, and visuospatial abilities, with no effects seen for learning and memory. The musically active group had greater gray matter volume in the somatosensory area, but did not differ from controls in higher-order frontal, temporal, or hippocampal volumes. However, the association between gray matter volume in distributed frontal-to-temporal regions and cognitive abilities was enhanced in participants with musical activity compared to controls. We show that playing a musical instrument during life relates to better late-life cognitive abilities and greater brain capacities in OA. Musical activity may serve as a multimodal enrichment strategy that could help preserve cognitive and brain health in late life. Longitudinal and interventional studies are needed to support this notion. (shrink)

Belief polarization is said to occur when two people respond to the same evidence by updating their beliefs in opposite directions. This response is considered to be “irrational” because it involves contrary updating, a form of belief updating that appears to violate normatively optimal responding, as for example dictated by Bayes' theorem. In light of much evidence that people are capable of normatively optimal behavior, belief polarization presents a puzzling exception. We show that Bayesian networks, or Bayes nets, can simulate (...) rational belief updating. When fit to experimental data, Bayes nets can help identify the factors that contribute to polarization. We present a study into belief updating concerning the reality of climate change in response to information about the scientific consensus on anthropogenic global warming. The study used representative samples of Australian and U.S. participants. Among Australians, consensus information partially neutralized the influence of worldview, with free-market supporters showing a greater increase in acceptance of human-caused global warming relative to free-market opponents. In contrast, while consensus information overall had a positive effect on perceived consensus among U.S. participants, there was a reduction in perceived consensus and acceptance of human-caused global warming for strong supporters of unregulated free markets. Fitting a Bayes net model to the data indicated that under a Bayesian framework, free-market support is a significant driver of beliefs about climate change and trust in climate scientists. Further, active distrust of climate scientists among a small number of U.S. conservatives drives contrary updating in response to consensus information among this particular group. (shrink)

Cleary discusses the origin, development, and use of the many senses of priority as a central thesis in Aristotle’s metaphysics. Cleary contends that one of the most revealing problems for the ambiguity of Aristotle’s relationship to Platonism is that of the ontological status of mathematical objects. In support of his claim, Cleary analyzes a curious passage from Aristotle’s _Topics, _where he appears to accept a schema of priorities that makes mathematical entities more substantial than sensible things. How does Aristotle try (...) to reconcile the ordering of things dictated by sciences like mathematics and dialectic with the ordering of sense experience upon which his own physics and metaphysics are based? To find the answer, Cleary reviews three different outlines of the many senses of priority given by Aristotle himself and found in _Categories _12-13, _Metaphysics _Delta 11, and _Metaphysics _Theta 8. Cleary suggests there is an implicit hierarchy for Aristotle that leads him to posit the Prime Mover at its apex as complete actuality and, therefore, as the focus for the concept of priority. Having reviewed Aristotle’s treatment of the many uses of priority, Cleary demonstrates how the concept is used in some typical arguments by Aristotle for his mature metaphysical positions. (shrink)

In the last two decades, interest in narrative conceptions of identity has grown exponentially, though there is little agreement about what a "life-narrative" might be. In connecting Kierkegaard with virtue ethics, several scholars have recently argued that narrative models of selves and MacIntyre's concept of the unity of a life help make sense of Kierkegaard's existential stages and, in particular, explain the transition from "aesthetic" to "ethical" modes of life. But others have recently raised difficult questions both for these readings (...) of Kierkegaard and for narrative accounts of identity that draw on the work of MacIntyre in general. While some of these objections concern a strong kind of unity or "wholeheartedness" among an agent's long-term goals or cares, the fundamental objection raised by critics is that personal identity cannot _be_ a narrative, since stories are artifacts made by persons. Towards the conclusion of the First Section of the Groundwork of the Metaphysics of Morals, Kant describes a process whereby a subject can undergo a kind of moral corruption. This process, which he calls a “natural dialectic”, can cause one to undermine one’s own or¬dinary grasp of the demands of morality. Kant also claims that this natural dialectic is the basis of the need for moral philosophy itself, since first-order moral reasoning is insufficient to protect against it. I show that (...) this passage is closely related to another in the First Section, one where Kant warns against the threat of “misology”, or the hatred of reason. I argue that both these passages must be read as engaging with specific claims from Rousseau’s writings. Uncovering the historical context and rhetorical function of Kant’s account of moral self-deception can re-orient the reader to his ambitions for the Groundwork itself. (shrink)

In this paper I refute the chief arguments for cultural relativism, meaning the moral (not the descriptive) theory that goes by that name. In doing this I walk some oft-trodden paths, but I also break new ones. For instance, I take unusual pains to produce an adequate formulation of cultural relativism, and I distinguish that thesis from the relativism of present-day anthropologists, with which it is often conflated. In addition, I address not one or two, but eleven arguments for cultural (...) relativism, many of which contribute to its popularity but receive scant attention from its critics. To elicit the failings of these arguments I deploy a host of pertinent but often neglected distinctions. (shrink)

Can we have objective knowledge of the world? Can we understand what is morally right or wrong? Yes, to some extent. This is the answer given by Adam Smith and Edmund Husserl. Both rejected David Hume’s skeptical account of what we can hope to understand. But they held his empirical method in high regard, inquiring into the way we perceive and emotionally experience the world, into the nature and function of human empathy and sympathy and the role of the imagination (...) in processes of intersubjective understanding. The challenge is to overcome the natural constraints of perceptual and emotional experience and reach an agreement that is informed by the facts in the world and the nature of morality. This article surveys arguments for the claim that employees have a right to strong forms of decision-making participation. Itconsiders objections to employee participation based on shareholders' property rights and it claims that those objections are flawed. In particular, it argues the employee participation rights are grounded on the same values as are property rights. The articlesuggests that the conflict between these two competing rights claims is best resolved by limiting the scope of corporate property rightsand by recognizing a strong employee (...) right to co-determine corporate decisions. Several contemporary Confucian philosophers have posited differing hybrid views fusing meritocracy to democracy. There is a good deal of interest in a meritocracy in contemporary Confucian thought, and such a view perhaps should receive more serious consideration in liberal democratic thought since it may make for a stronger form of government when appended to democracy. In this paper, four contemporary hybrid theorists who combine elements of a meritocracy with a democracy are critically analyzed concerning an ability for their views to (...) be instantiated in liberal democracies for the legislative branch only. The United States is distinctive among advanced economies in that its employment laws and practices are governed byEmployment at Will (EAW). Most other nations have variations on Just Cause dismissal rules. I argue that the U.S. preference for EAW is unsupported by concerns about net social or economic consequences. By the term "psychology" Husserl means a descriptive and genetic psychology which seeks to characterize the contents and structure of particular experiences and to investigate the genetic relations between different experiences. Included among the genetic questions concerning space is the problem of the origin of the science of space.

In discussions of practical reason we often encounter the view that a fact is a reason for an agent to act only if the fact is capable of moving the agent to act. This view figures centrally in many philosophical controversies, and while taken for granted by some, it is vigorously disputed by others. In this essay I show that if the disputed position is correctly interpreted, it is well armored against stock objections and implied by a premise that is (...) not only plausible, but generally accepted by the position's critics.
